This indenture made the fourth day of September in the fifth year of the reign of our Sovereign Lady Anne by the grace of God of England Scotland France and Ireland Queen defender of the faith:
Between John Ley of Tawstock in the county of Devon yeoman Richard Melhuish of the same pishe gent . John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland of Tawstock aforesaid yeomen feoffees in trust of the lands belonging to the poor of the pishe of Tawstock aforesaid of the one part And Lawrence Mitchell of Great Torrington in the said county of Devon Weaver of the other part witnesseth that the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland for and in consideration of the sum of seven pounds of good and lawfull money of England unto them in hand paid by the said Lawrence Mitchell at and before the sealing and delivery of these present whereof they the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland do acknowledge the receipt and thereof and of every part and gross thereof do aquitt release and discharge the said Lawrence Mitchell his executors and nominees for ever by the presents have demised leased granted and to farme letten and by these presents do demise lease grant and to farme lett and sett unto the said Lawrence Mitchell his exectutors administrators and assignees all that messuage courtage and garden with the appurteness situate lying and being in a certain street called Mill Street within the towne of Great Torrington aforesaid and late in the tenure or occupation of one Thomas Dendle of Great Torrington aforesaid roper and now in the tenure or occupation of the said Lawrence Mitchell his assignee or assignees or under tenants to have and to hold and so hold the said messuage courtage and garden with the appurtonees unto the said Lawrence Mitchell his exectutors administrators and assignees for and during the terme of four score and nineteen years fully to be compleat and ended if he the said Lawrence Mitchell and Thomas Mitchell the son of John Mitchell of Great Torrington aforesaid weaver or either of them so long shall happen to live the said term to commence and beginn immediately from and after the death of Benjamine Dendle of Great Torrington aforesaid yeild in the and paying therefore yearly after the commencement of the said terme and during the same unto the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland their heirs and successors six shillings and eight pence of good and lawfull money of England all the foremost usual feasts in the year (that is to say) the feast of the birth of our Lord God the Annuntiation of our blessed lady Mary the Virgin the nativity of John the baptist and St Michael the Archangell by even and equell portions during the said terme the first payment thereof to be made on the first of the said feasts that shall happen next after the comencement of the said terme and also yeilding and paying upon and after the death of the said Lawrence Mitchell and Thomas Mitchell dying after the comencement of the said term one shilling of lawfull money of England for and in the name of the Herriott or sarleive provided always that living the said Lawrence Mitchell no surhsume aforesaid shall be paid upon or after the death of the said Thomas and the said Lawrence Mitchell doth for himself his exectutors administrators and assignees and for every of them covenant promise and grant to and with the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland their heirs and successors and to and with every of them by these presents that he said Lawrence Mitchell his exectutors administrators and assignees and every of them shall and will from time to time and at all times hereafter during the said terme will and sufficiently repair uphold sustain and maintain all and sigular the said demise premisses with the appurtences as within houses walls and coverings as in hedges ditches and fences and in all other needfull and nescessary reparations when and as often as need shall require at his and their owne proper costs and charges during the said terme and in thone hereof to leave and yeild up the same well and sufficiently repaired and maintanined and if it happen the said yearly rent of six shillings and eight pence of lawfull money of England or any part thereof to be behind or unpaid in part or in all by the space of one month next after any of the said feasts in which the same ought to be paid as aforesaid being the lawfully demanded and no sufficient distress in or upon the premises can or may be found whereby to levy the same with the arrearages thereof (if any bee) or if the said Lawrence Mitchell his exectutors administrators and assignees or any or either of them shall do or comitt any wast or permit or suffer any the premises to be in decay to the value of ten shillings of lawfull money of England or above at any time or times during the said terme and the same shall not repair and amend againe within the space of one half year next after notice or warning those of given to the said Lawrence Mitchell his exectutors administrators and assignees or else shall do any act or acts that shall or may be prejudicial or hurtfull unto the estate of the said Feoffees during the said term without their or most of their consent or agreement these unto first had and obtained that then and from thence forth for every or any of the causes aforesaid if it shall and may be lawfull so and for the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland their heirs and successors into all and singular the premises before granted with the apputences to reenter and the same to have against refrain as in his or their former estate these presents or anything as in his or their former estate these presents or anything herein contained to the contrary thereof in any wise not withstanding and the said Lawrence Mitchell doth for himself his exectutors administrators and assignees and for every of them further coven promise and agree to and wish the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland and so and with every of them heirs and succesors by these presents that he the said Lawrence Mitchell his exectutors administrators and assignees and for every of them shall and will during the terme hereby granted yeild and pay all and all manner of rates taxes or impositions laid upon the premisess as well monthly rates, rates to the poor hurth or other rates or taxes what so ever (the high and sheise rent issuing out of the premises unto the high lord only exepted) and thereof and every part thereof to aquitt and dischage the said Feoffees their heirs and successors during the terme aforesaid and the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland and every one of them do generally and respectively and not one for another and for every and either of their heires and assignees covenant and promise to and with the said Lawrence Mitchell his exectutors administrators and assignees and every of them shall and may by and under the rents covenants and conditions above said peaceably and quietly have hold occupy posses and enjoye all and singular the premises aforesaid with the appurtences without any lett trouble molestation suit contradition or demall of the said John Ley Richard Melhuish John Sloley John Ley junior Hugh Ley Maurice Nicholls Richard Limeberry Thomas Farmer and Aviholaus Arkland their heirs Extracted from the District Registry attached to the Probate Division of Her Majesty's High Court of Justice at Exeter.
This is the last Will and Testament of me John Michell of Totnes in the County of Devon Gentleman that is to say I give devise and bequeath unto
and to the use of my two daughters Elizabeth Michell and Mary Michell their several and respective heirs executors administrators and assigns equally
to be divided between them as tenants in common and not as joint tenants according to the nature and quality thereof respectively all that messuage
tenement or dwelling house garden outhouses and premises wherein I reside and also all that garden orchard and premises situate in Leechwell Lane
within the said parish of Totnes and also all and singular my plate linen china household goods and furniture and effects that I shall die possessed
of Also I give devise and bequeath unto my two sons the Reverend Richard Michell of the University of Oxford Clerk and Edward Michell of Bruton in
the County of Somerset their heirs executors administrators and assigns all that my capital messuage or tenement closes pieces or parcels of land
hereditaments and premises and estate called Holsome otherwise Holdsome situate lying and being within the parish of Diptford otherwise Deptford
in the said County of Devon and also all and singular other my messuages or tenements lands hereditaments real estate and estates whatsoever and
wheresoever upon the trusts nevertheless and to and for the several ends intents and purposes hereinafter expressed and declared of and concerning
the same that is to say upon trust that they my said trustees or the survivor of them his heirs executors or adminstrators shall and do with all
convenience speed after my decease either by private contract or public auction sell and despose of all and singular the said several estates lands
hereditaments and premises either together or in parcels to such person or persons as shall be willing to become the purchaser or purchasers thereof
for the best price or prices that can be reasonably had or gotten for the same and upon further trust that they my said trustees or the survivor of
them his heirs executors or administrators shall and do by and out of the monies to arise and be produced from the said estates lands heredaments and
premises in the first place pay satisfy and discharge my funeral expenses and the costs of proving my Will and in the next place shall and do retain
to and keep or pay over to themselves my said sons Richard Michell and Edward Michell their several and respective executors administrators or assigns
all sum and sums of money now due and owing and hereafter to grow due and owing from me to them respectively on mortgage bond note or memorandum and
the interest thereof respectively and also shall and do pay satisfy and discharge all such other debt and debts of what nature or kind soever as shall
be in any respect due and owing from me to any other person or persons whomsoever at the time of my decease and from and after full payment and
satisfaction of all my debts as aforesaid shall and do divide the residue of the said trust monies between my five children John Nosworthy Michell
themselves the said Richard Michell and Edward Michell Elizabeth Michell and Mary Michell their several and respective executors administrators and
assigns equally to be divided between them share and share alike the same to be vested interests in each and every of my said children immediately on
my decease and I do further declare and direct that from and after my decease until the sale hereby directed to be made of the said estates lands
hereditaments and premises as aforesaid shall be made and executed the rents issues proceeds and profits thereof shall be paid to such persons and
applied to such purposes and in the same proportion and manner as the monies arising from such sale would after such sale be payable or applicable
to by virtue or in pursuance of this my Will and for facilitating the sale of the said estates lands hereditaments and premises under the trusts
aforesaid I do declare and direct that the receipt or receipts of my said trustees Richard Michell and Edward Michell or the survivor of them his
heirs executors administrators or assigns of the said trust estates and premises hereby directed to be sold and disposed of for the purposes aforesaid
or for the rents issues profits and proceeds thereof in the meantime under their or his hands or hand respectively shall from time to time be a good
and sufficient discharge or discharges to the purchaser or purchasers of the same hereditaments and premises or other person or persons paying the
same and his her and their heirs executors administrators and assigns for so much thereof as in such receipt or receipts shall be expressed or
acknowledged to be received and that the purchaser or purchasers person or persons paying the same shall not after such receipt or receipts given
be liable or accountable for the application nonapplication or misapplication of such money or any part thereof or be at all concerned to see or
attend to the application thereof and I constitute and appoint my said sons Richard Michell and Edward Michell Executors of this my last Will and
Testament upon the trusts nevertheless and to and for the intents and purposes aforesaid and I do declare that my said trustees and executors their
several and respective heirs executors administrators and assigns shall not be answerable or accountable the one for the other of them or for the
acts deeds defaults receipts payments or disbursements of the other of them or for any loss or damage which shall or may happen or arise to any of
the said trust estates and premises by the failure of purchasers tenants bankers or otherwise howsoever and that they shall and lawfully may in the
first place retain deduct and reimburse themselves respectively and each of their cotrustee by and out of the sale trust estates and premises all
such loss costs damages charges and expenses as shall be occasioned by the execution of the trusts in them reposed or in defence of the said trusts
or trust estates or otherwise howsoever relative thereto. In witness wereof I the said John Michell have to this my last Will and Testament contained
in this and the two preceeding sheets of paper set my hand and seal that is to say my hand to the bottom of each of the said two preceeding sheets
and my hand and seal to this third and last sheet of paper and my seal at the top of the first of the said sheets where the same are all fixed together
the nineteenth day of January in the year of Our Lord One Thousand eight hundred and ten ---Jno Michell (seal) ---
The writing contained in this and the two preceding sheets of paper were signed and sealed by the above named John Michell the testator and by him
published and declared as and for his last Will and Testament in the presence of us who have hereunto at his request and in his presence and in the

This is the last Will and Testament of me Mary Michell of Totnes in the County of Devon spinster in manner following, that is to say, First I direct
that all my just debts of what nature or degree soever funeral expenses and costs of proving my will shall be fully paid and satisfied and subject
thereto I give devise and bequeath unto and to the use of my sister Elizabeth Michell her heirs executors administrators and assigns for ever according
to the nature and quality thereof respectively all and singular my messuages lands tenements heredaments real estate and estates monies securities for
money mortgages in fee and for years and the hereditaments and premises therein respectively comprised for all my estate and interest therein goods
chattels personal estate and effects whatsoever and wheresoever and in possession reversion remainder expectancy or otherwise howsoever to hold the
same and every of them and every part thereof unto and to the use of my said sister Elizabeth Michell her heirs executors administrators and assigns
for ever according to their natures and qualities thereof respectively And I constitute and appoint my said sister Elizabeth Michell sole executrix of
this my last Will and Testament and I revoke all former Wills and Testaments and do declare this to be my last Will and Testament. In witness whereof
I the said Mary Michell have to this my last Will and Testament contained in this one sheet of paper set my hand and seal the eighteenth day of December
One thousand eight hundred and eleven. ----
